Key terms at a glance
Who can rent
Drivers 21+ with a valid license for the whole rental. Ages 21–24 and 75+ pay $21.95/day. Every driver must be listed on the agreement.
Payment & deposit
Physical Visa, Mastercard or Discover in the renter's name. Deposit: $300–$2,500 depending on residency and coverage — released at return, minus anything owed.
Insurance
Bring your own qualifying policy (Declaration Page required) or buy coverage at the counter. In Florida, your own insurance is primary by law.
Tolls
Florida tolls are cashless. Every car carries SunPass: $19.95/day unlimited, or $14.95/day E-Toll activation plus the tolls you actually use.
Florida only
Vehicles stay inside Florida unless we authorize out-of-state travel in writing before pickup. Unauthorized travel is a breach with recovery costs.
Cancellation
Full refund if you cancel 48+ hours before pickup. Later cancellations and no-shows aren't refunded, but you keep a 24-month rebooking credit.
The agreement
These Terms & Conditions ("Terms"), together with the rental agreement you sign at pickup and any addenda, form the entire agreement ("Agreement") between you and Clubs Car Rental ("CCR", "we") for the rental of a vehicle, its keys, accessories, documents and any optional equipment (together, the "Vehicle"). If these Terms and the signed rental agreement conflict, the signed rental agreement controls.
A reservation is a booking, not the rental contract — the contract is formed at pickup when your documents are verified and the rental agreement is signed. Electronic signatures are treated as originals.
The renter and every additional driver are jointly and severally responsible for all obligations under the Agreement. By driving the Vehicle, an additional driver accepts these Terms.
The Vehicle remains our property at all times. You receive possession only — no lease, ownership interest, or right to sublease, lend, or transfer the Vehicle. We provide the Vehicle as-is for rental purposes and disclaim all implied warranties to the extent the law allows. Do not authorize repairs without our prior written approval; unapproved repair costs are not reimbursed.
Driver eligibility & licenses
The minimum rental age is 21. Drivers aged 21–24 pay a Young Driver Fee of $21.95/day; drivers aged 75 and over pay a Senior Driver Fee of $21.95/day. These fees apply per driver and are itemized before you confirm.
Every renter and additional driver must present, at pickup, a valid, unexpired driver's license that remains valid for the entire rental period, plus a second form of ID if requested. As Florida law requires (Fla. Stat. §322.38), we inspect every license and keep a record of the driver's name and address, license number, issuing jurisdiction, date and place of issuance, and the vehicle's registration number, available to law enforcement.
Out-of-state and foreign licenses are accepted if valid in Florida. Licenses not printed in the Roman alphabet must be accompanied by an International Driving Permit or a certified translation. Digital-only licenses are accepted only where we can verify them.
Only the renter and the additional drivers listed on the rental agreement may operate the Vehicle. Letting anyone else drive is a breach that voids all waivers and protections.
Up to three drivers may be listed on one agreement, the renter included. The first additional driver is free; the third driver is $9.99/day for the whole rental. Each driver is subject to the age fee in their own right.
We may decline a rental if a license is expired, suspended, or cannot be verified, if the rental requirements in these Terms are not met, or based on documented prior rental history or safety or fraud concerns, consistent with applicable law — in that case the reservation is treated under the cancellation policy below.
Payment methods
A physical credit card — Visa, Mastercard or Discover — in the renter's own name is required at pickup. American Express, virtual cards, prepaid cards and gift cards are not accepted.
Debit cards are accepted only for non-Florida residents traveling by air who present a return airline ticket. Debit-card rentals may carry stricter verification and a larger deposit hold, disclosed before you confirm; we are not responsible for overdraft fees your bank charges on holds.
A third party's credit card may be used only if the cardholder is present at pickup with valid ID and signs the payment authorization.
You authorize us to charge the card on file for all amounts due under the Agreement — including charges identified after return, such as tolls, citations, fuel, cleaning or damage — with itemized documentation provided for every post-return charge, and to re-attempt any payment that is declined or reversed.
The payment options available for a booking are the ones shown at checkout before you confirm, and no others. Pay at pickup means nothing is charged on this website: the booking is charged in full at the counter, at the standard total shown to you at booking — which already includes taxes, the state surcharge and the optional products you selected. Pay now, where it is offered, means you pay that booking in advance on this website, by card or a supported digital wallet, for the prepaid total displayed at checkout; that total already reflects any prepayment discount we are offering at the time, and it is the amount charged.
Completing a booking on this website reserves the vehicle class you selected for the dates and offices you selected. Your booking is confirmed when you complete it here; it does not wait on a separate approval from us. Payment is a separate matter: whether you pay now or at pickup does not change whether the booking exists, and a booking that is unpaid, still settling or declined online remains a booking, with the amount then due at the counter. Our payment provider processes the payment only — it does not create, confirm or hold a booking on our behalf, and its payment receipt is a receipt for money, not the booking itself. If we cannot provide a vehicle in the reserved category or similar, the substitution-or-refund remedy in Cancellations and in the Liability section applies.
Prepaying does not cover the security deposit, which is never charged on this website — it remains an authorization hold taken on a physical credit card at pickup, under the Security deposit section below. Early returns are not refunded (see Pickup, return & late returns).
Security deposit
A security deposit is authorized on the renter's credit card at pickup:
- Florida residents using their own qualifying insurance: $2,500.
- Non-Florida residents using their own qualifying insurance: $1,000.
- Any customer purchasing coverage from us (Florida resident or not): $300–$1,000, set by vehicle class and shown before you confirm.
- Midsize, SUV and Minivan at our Florida offices, booked at the published daily rates above: $300.
Deposit Waiver: for $12.99/day, non-Florida residents may waive the deposit requirement. The waiver removes the deposit hold only — it is not insurance and does not change your responsibility for the Vehicle.
The deposit is an authorization hold, not a charge. At return, we release the hold minus any amounts you owe. Your card issuer — not CCR — controls when released funds reappear in your account, typically 3–10 business days.
The deposit does not cap your responsibility: if amounts due exceed the deposit, you remain responsible for the difference.
Insurance & optional protections
Florida statutory notice (reproduced as required on the rental agreement): "The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes." In plain terms: your own auto insurance pays first, up to Florida's required limits.
To rent using your own insurance you must present a valid Insurance Declaration Page (insurance ID cards are not accepted) showing Collision, Comprehensive, Liability and Property Damage coverage with limits of at least $500,000 combined, in the renter's name and address, active for at least 3 months.
We accept policies we can verify electronically — including State Farm, GEICO, Progressive, Liberty Mutual, USAA, Farmers and Nationwide. Policies issued in Puerto Rico or Canada cannot be verified by our system and are not accepted. If your policy does not meet these requirements, coverage must be purchased at the counter.
Credit-card rental coverage is accepted only with an official confirmation letter from the issuing bank; if it excludes liability coverage, liability protection must be purchased at the counter.
Collision Damage Waiver (CDW) — an optional contractual waiver, not insurance — waives your responsibility for accidental damage to the Vehicle, except tires, wheels and glass. Supplemental Liability Insurance (SLI) is also available at the counter. Daily prices are disclosed before you sign. Your own policy or credit card may already duplicate these protections; buying them is never required to rent.
Any waiver or protection is void if the Vehicle is used in breach of the Prohibited Uses section, driven by an unlisted driver, or if an accident or theft is not reported to us and the police as required below.
Permitted & prohibited use
The Vehicle may be used only on paved public roads, by listed drivers, in compliance with all laws — including Florida's Safety Belt Law (§316.614) and child-restraint law (§316.613, children 5 and under; you are solely responsible for providing or renting an appropriate child seat and for its installation).
The following are prohibited and void all waivers and optional protections, authorize us to recover the Vehicle immediately, and make you responsible for all resulting loss:
- Driving by anyone not listed on the rental agreement.
- Driving under the influence of alcohol, drugs, or any impairing substance, or use in any crime.
- Racing, speed testing, driver training, or towing or pushing anything.
- Off-road, beach, or unpaved-surface driving.
- Carrying passengers or property for hire — including rideshare (Uber/Lyft) and delivery services.
- Carrying more occupants than seat belts, hazardous materials, or unsecured loads or animals.
- Smoking or vaping in the Vehicle ($250 restoration fee).
- Using the wrong fuel type, ignoring warning lights, or continuing to drive an unsafe vehicle.
- Leaving the Vehicle unlocked or with keys inside, tampering with the odometer or the SunPass device, or obtaining the rental by fraud or false information.
Where you can drive
Vehicles may be operated only within the State of Florida. Out-of-state travel is permitted only with our prior written authorization and an out-of-state fee quoted to you in writing before pickup — contact us to request it. Taking the Vehicle outside Florida (or onto a ferry) without authorization is a material breach: it voids all waivers and protections and makes you responsible for recovery, towing and transport costs.
Mileage — non-Florida residents: unlimited within Florida unless your rental agreement states otherwise. Florida residents: 50 miles per day included; additional miles at $0.99 per mile.
Fuel
The Vehicle leaves with a recorded fuel level and must come back at the same level. If it returns lower, we charge the missing fuel at the per-gallon refueling rate posted at the counter, which includes a refueling service and is higher than local pump prices. No credit is given for returning with more fuel.
Using the wrong fuel type is a prohibited use: you are responsible for the resulting damage, draining and towing, and no waiver covers it.
Tolls & SunPass
Florida toll roads are cashless — you will incur electronic tolls. Every Vehicle is equipped with a SunPass transponder. Choose at pickup:
- Unlimited toll package: $19.95/day — all Florida tolls included.
- E-Toll activation: $14.95/day, plus the actual tolls you incur — the tolls are charged to your card separately after return.
Personal transponders cannot be used with our vehicles, and removing or tampering with the installed SunPass device carries a $500 penalty.
Under Fla. Stat. §316.1001, toll citations go to the vehicle owner; you authorize us to identify you as the driver to toll authorities by affidavit, transferring citation liability to you, and to charge your card for tolls and related amounts.
Charges, taxes & fees
Published daily rates at our Florida offices — Miami, Fort Lauderdale and Orlando: Midsize $45, SUV $55, Minivan $70. These rates include Clubs Standard Cover, a collision damage waiver carrying a $2,500 deductible, and require a $300 security deposit. They are available for rentals through November 15, 2026; rates for other vehicle classes and for our other offices are quoted before you confirm.
A rental day is a consecutive 24-hour period from pickup time, with a 30-minute return grace period. All charges are itemized on your quote and receipt. In addition to the base rate:
- Florida sales tax (6% plus applicable county surtax).
- Florida Rental Car Surcharge: $2.00 per day or part of a day (state-imposed, first 30 days of the rental).
- Airport facility and license-recovery fees where applicable, shown as separate line items at booking.
- Young Driver (21–24) or Senior Driver (75+) fee: $21.95/day per driver.
- Additional driver: the first one is free; the third driver on the agreement is $9.99/day.
- Child/infant seat: $9.99/day, capped at $70 per rental.
- Optional roadside assistance: $4.95/day (without it, lockouts, jump-starts, flat-tire service and key issues are billed at cost).
- Prepaid fuel service: $85 one-time — pay for the tank up front and return the Vehicle empty. No credit is given for unused fuel.
- GPS navigation unit: $9.99/day.
- Prepaid SIM card: $50 one-time — unlimited talk and text with 7 GB of data, for use in any unlocked compatible phone.
- One-Way Fee, charged once per rental when the return office is not the pickup office: Miami ↔ Fort Lauderdale $50; Miami ↔ Orlando $150; Fort Lauderdale ↔ Orlando $150. It is quoted before you confirm and does not depend on how long you rent.
- Deposit Waiver (non-Florida residents only): $12.99/day — see the Security deposit section.
- Smoking/vaping restoration fee: $250. Excessive cleaning (heavy soiling, pet hair): up to $250, based on the required detailing.
- Lost or damaged keys/fobs: $500–$750 depending on key type, at replacement cost.
- Traffic, red-light, parking or toll violations: the fine plus a $95 administrative fee per violation.
- Returned-payment fee (up to the maximum service fee permitted by Fla. Stat. §832.08) and reasonable collection costs, including attorney's fees, on unpaid amounts.
Charges continue to accrue until the Vehicle is returned and inspected (or reported stolen to the police). We never charge a fee that is not described in the Agreement.
Pickup, return & late returns
Reservations are held for 1 hour after the scheduled pickup time during business hours. If you are delayed, contact us before the hold expires to keep the reservation — otherwise it becomes a no-show.
Reservations guarantee a vehicle category, not a specific make or model. We may substitute a similar or upgraded vehicle at no extra cost.
Return the Vehicle on the date, time and location agreed, in the condition received minus ordinary wear. Returns more than 30 minutes late are charged at one-quarter of the applicable standard daily rate per hour started, capped at one full day per 24-hour period; promotional rates do not apply to overdue days. Extensions must be approved by us before the due time — keeping the Vehicle without approval is an unauthorized extension.
Early returns are not refunded. Rentals may not exceed 30 consecutive days without a written renewal.
After-hours drop-off is available by prior arrangement; the Vehicle remains your responsibility — including damage, theft and accruing charges — until our staff inspect and accept it the next business day.
Hourly rentals (4-hour minimum) and monthly rentals are available — ask for current rates.
Cancellation, no-shows & rebooking credit
These rules operate on the amount you have actually paid at the moment you cancel. If you had not yet paid — the ordinary case when you chose to pay at pickup — there is nothing to refund and no rebooking credit arises: the reservation is simply cancelled at no charge. If you had prepaid, the refund or the credit below is calculated on the amount actually charged, and a refund is returned to the payment method it was charged to. Where the prepayment was made in crypto, our payment provider returns the refund as stablecoins to the wallet the payment came from; the amount refunded is the amount calculated under these rules, and network conditions and timing are outside our control.
Cancel 48 hours or more before pickup: full refund to your original payment method.
Cancel less than 48 hours before pickup, or no-show: no refund — but the amount paid is kept as a rebooking credit valid for 24 months from the original pickup date.
Rebooking credit conditions: non-transferable, redeemable once toward any reservation of equal or greater value (you pay the difference at current rates), and unused credit expires after 24 months.
If we cancel a reservation because rental requirements were not met at pickup (license, payment, insurance), the no-show rule applies — unless the failure is attributable to us, in which case you receive a full refund. If we cannot provide a vehicle in the reserved category or similar, you receive a full refund — our responsibility is limited to the substitution-or-refund remedy in the Liability section.
Vehicle condition & damage responsibility
Inspect the Vehicle before leaving and report any pre-existing damage — photos are recommended; we document the Vehicle's condition at pickup and return, and you may request a copy.
Unless a purchased waiver applies, you are responsible for damage to or loss of the Vehicle during the rental regardless of fault — including collision, vandalism, theft, weather, flood and glass/tire damage — measured as:
- The cost of repair, or the Vehicle's fair market value less salvage if it is a total loss (whichever is less);
- Plus actual towing, storage and impound charges;
- Plus loss of use, calculated as the Vehicle's daily rental rate multiplied by the actual days it is out of service for repair;
- Plus diminished value, determined by independent appraisal;
- Plus a claims administrative fee of $95 per damage claim.
We provide an itemized statement with supporting documentation for every damage charge, and only charge what the Agreement describes. You authorize us to present the claim to your insurer on your behalf where permitted.
Accidents, theft & breakdowns
In any accident, theft or vandalism: ensure safety first, then report it to the police immediately (a police report is required for theft and for any accident with injuries or third parties) and notify us within 24 hours at +1 800-437-5707.
Collect the other party's and witnesses' details, do not admit fault, forward us every legal document you receive, and cooperate fully with us, our insurers, and authorities in any investigation or defense. Failure to report or cooperate voids all waivers and optional protections.
If the Vehicle breaks down through no fault of yours, call us — we will repair or replace it. Our responsibility for breakdowns and delays is limited to a replacement vehicle or a refund for the unused rental period. Do not authorize repairs yourself without our written approval.
GPS, telematics & privacy
Our vehicles are equipped with GPS/telematics devices and may include event data recorders. You consent to our collecting vehicle location, odometer, fuel and diagnostic data, and to our locating the Vehicle when it is reported stolen, significantly overdue, or suspected outside the permitted area — and you will inform every driver and passenger of this.
Event data around a collision may be used to investigate incidents and support claims. We do not monitor your location in real time as you drive.
If you pair a phone, delete your data from the infotainment system before return; we clear paired-device lists during preparation but cannot guarantee the manufacturer's system retains nothing.
How we handle personal information — including license, payment and telematics data — is described in our Privacy Policy, which is incorporated into the Agreement by reference.
Liability & indemnification
You are responsible for, and agree to indemnify, defend and hold CCR harmless from, all claims, liabilities, damages and costs (including reasonable attorney's fees) arising from your or any driver's use of the Vehicle, except to the extent caused solely by our negligence.
As a rental company, CCR is not vicariously liable for harm caused by renters or drivers to the fullest extent of the federal Graves Amendment (49 U.S.C. §30106). Any protection we are required to provide is limited to Florida's minimum financial responsibility limits unless you purchase optional SLI.
We are not liable for indirect, incidental, special or consequential damages — including missed flights, lost profits or trip interruption. For any failure on our side, your remedy is limited to a replacement vehicle or a refund of amounts paid for the unused period.
We are not responsible for personal property left in or transported with the Vehicle, on our shuttles, or at our premises — including data left on the infotainment system. Check the Vehicle before returning it; found items are held 30 days.
Nothing in these Terms limits rights that Florida consumer-protection law does not allow to be limited.
Failure to return the vehicle
Florida statutory notice (initialed on the rental agreement as required by Fla. Stat. §812.155(6)): "Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes." In plain terms: not returning the Vehicle and not paying what is due is treated as abandonment, a criminal offense under Florida law.
If the Vehicle is not returned when due, we will demand its return in writing, by certified mail or personal delivery, to the address on your rental agreement (keep it current). Failure to return within 5 days of that demand is prima facie evidence of abandonment under Florida law, and we may report the Vehicle stolen.
We may repossess the Vehicle without notice, wherever found, at your expense — including locate, recovery, towing and attorney costs — if it is overdue, abandoned, illegally parked, obtained by fraud, or used in breach of the Agreement. Where permitted, this includes locating and remotely disabling the Vehicle.
Governing law & disputes
The Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Before filing any claim, you agree to send us written notice at info@clubsenterprise.com describing the dispute and give us 30 days to resolve it in good faith.
Any dispute not resolved informally will be decided by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, held in the Florida county where your rental commenced. BOTH PARTIES WAIVE JURY TRIAL AND CLASS ACTIONS — claims proceed individually only. Either party may instead use small-claims court for qualifying claims, and personal-injury and insurers' claims are excluded from arbitration.
You may opt out of arbitration by emailing us within 30 days of your first rental under these Terms. If the class-action waiver is found unenforceable, class claims must proceed in court, not arbitration. Court proceedings for excluded claims take place in the courts of the county where your rental commenced.
General provisions
Entire agreement — the Agreement supersedes all prior discussions and representations, including anything said at the counter that contradicts it.
Modifications — no term can be changed or waived except in writing signed by an authorized CCR representative; rental-counter staff are not authorized to modify these Terms.
No waiver — accepting payment or not enforcing a breach once does not waive our right to enforce it later.
Severability — if any provision is found invalid, it is reformed as narrowly as possible or severed; the rest of the Agreement remains in force.
Assignment — we may assign the Agreement or amounts due under it; you may not assign the Agreement or transfer the Vehicle.
Force majeure — we are not liable for failure to provide a reserved vehicle due to events beyond our reasonable control (weather, prior-renter damage or late return, mechanical failure, recalls, government action); your remedy is a similar substitute or a full refund.
Language — these Terms are published in English and Spanish for convenience; if the versions ever diverge, the English version controls.
Updates — we may update these Terms for future rentals; the version in force when your rental agreement is signed governs that rental. The date above reflects the current version.
